    ....and a toast to a wish for "no surprises" in a pelvic MRI I have scheduled for Sept 27 by the very thorough Johns Hopkins doctor I saw today. May it be the most boooooring imagery with absolutely nothing to report.

    Athena, the scans will be so uneventful and downright boring that I'm falling asleep just thinking about them.  I may just pass out on my keyboarddddddddddddddddd...............................

    Well, how about some intersting reading, then...I was intrigued by the first San Francisco case mentioned (my bold):

    "Many of the seminal cases in defamation law have arisen out of articles published in newspapers.  However, in today's world of Web 2.0, where websites such as Yelp.com ("Yelp"), have turned the average person into an online publisher, the law of defamation may be changing.  In the past year, Yelp's online reviews have spawned at least three lawsuits alleging defamation.  One San Francisco lawsuit filed by a chiropractor who was negatively reviewed, settled in mediation earlier this year.  A second suit, filed in Santa Clara County by a pediatric dentist is pending on appeal after the judge denied defendants' (the patient's parents) anti-SLAPP (Strategic Lawsuits Against Public Participation)[1] motion because the dentist demonstrated a probability of success on the merits, which allowed the case to continue.  The third San Francisco lawsuit also involved a dentist and settled last year after the judge granted the defendant's anti-SLAPP motion.

    Overcoming the anti-SLAPP hurdle by demonstrating the probability of success on the merits of a defamation case at the outset of the litigation is often difficult because not all negative comments about a business or service are actionable.  In Milkovich v. Lorain Journal Co. (1990) 497 U.S. 1, the United States Supreme Court clarified the law of defamation as it pertains to opinion statements.  The Court ruled that opinion statements based on false facts are actionable, but specifically excepted statements of opinion based on true and disclosed facts.  See Milkovich, 497 U.S. 1, 11-23.  After Milkovich, the relevant question is not merely whether the published statement is fact or opinion, but whether a reasonable fact finder could conclude that the published statement declares or implies a false assertion of fact.  See Franklin v. Dynamic Details, Inc. (2004) 116 Cal.App.4th 375, 385."

    There is only ONE thing that Karl Rove and I can agree on: "You can run but you can't hide." It pertains to both civil and criminal law. Nothing in cyberspace really gets lost.

    Silly really, if one thinks they can get away with something on the internet that they can't get away with up close and personal.  Libel is the written word for slander, and a lot easier to prove.

    "Nothing in cyberspace really gets lost".  Absolutely correct, Athena.  There is no hiding -- behind whatever nom de plume (or nom de "net"!).  I attended a HS reunion last week and had a MOST interesting conversation with a classmate who has just retired from RIM (Blackberry maker) but still consults for the company.  What he told me about internet privacy ( there is NONE, if you know where to look) shocked me silly!

    Good morning and good night ladies!!!!

    Been a busy day - housecleaning for my trainer, working my horse, coming home and totally cleaning the interior of my car, housesitting.....the list goes on and on and on.  I started at 9 am this morning and didn't stop until 9:30 pm tonight.

    Tomorrow will be another rough day so I won't be able to be around much.

    Good news is that my tooth doesn't hurt.  I am about a pain level 3-4 with my hips which means it is a good day for me.

    My border terrier (Abbey) is in bed waiting for me so I am going to jump off.  I already took my ambien for the night although I don't anticipate falling asleep for at least another 30 minutes or so and yet it is already midnight.

    Have a great weekend everyone and I will pop in when I can.  Do know that I am at the least reading and trying to stay caught up.

    Barbara - great news on your 2nd interview - I read where you actually have a day and time set up now.

    Sealed regarding the review site.  I can't believe the nastiness continues on and on.

    The weather has cooled off here too ... I love it!  We took the doggies for a long walk in the park yesterday and it was just beautiful outside.

    Congratulations on new grandbabies and 2nd job interviews and fun trips and all the other good stuff going on in everybody's lives!

    Bren, have a really happy day today.  Watch out with those high heels, though.  A cast on your arm doesn't make much of a fashion statement...  :)

    Jancie, I hope your weekend stays busy but happy.  Do horse stuff -- it seems to be therapeutic, yes?

    And, Athena, here's hoping they find only the stuff they're supposed to find on that pelvic MRI.  I've had two of those, for reasons relating to a previous medical problem.  They really are boring.  I fell asleep during the most recent one, despite that idiot who was pounding on the outside of the metal garbage can they'd put me in.

    Good Morning Everyone!

    Thanks for all the wonderful b-day wishes.  So far I've had a morning nap while Tim cleaned the kitchen!  Wonderful start to the day!

    E .. not pruning trees today, too wet outside.  I promise I'll be careful in my new shoes.  They do look great on my feet though!

    Well .. Tim wants to use the computer .. he's looking for a new company.  He just isn't getting enough miles where he currently works.  This is so stressful!  arghh.

    Sunflowers - one of my most favourite memories of this trip will be the happy fat cows and sheep I've seen.

    The hotel we are in is great. We did get to spend half of the day with the baby and Mark - DIL from hell stayed home. She texts him every f-ing 5 minutes - really creepy behaviour. He said  he was giving her the day off - talk about under the thumb. At least we didn't have to put up with her. I can tell she doesn't like me - she is obviously threatened by anyone close to our son. I've been doing the sookie mummy thing on him - works well - a few tears and lots of hugs:)

    We have offered to mind the baby tonight so they can go to the movies. He is so cute and was no bother all afternoon. What pissed me off, was that we had to wait until lunchtime to get to see him. Sounds like we might get to see them again tomorrow - we'd better - we did come on this trip to spend time with him.

    I've decided being a granny isn't so bad - he does smile at me - bless his little heart.

    We both can't wait to go home - it's so crowded over here.
