Wondering if I need a will. For those who don't know I am divorced and have two sons. My car is in my or ds1 name. I am living in an apartment . Not alot of assets now. Bank acct has my name and ex signed a form that he can't access account unless he has a death certificate of mine. Life insurance is not included in wills. Custody would automatically be ex's

I have given family and friends those items of mine that I want them to have. Going to take all jewelry - which I don't ever wear anyway - esp wedding and engagement rings to be melted down and diamonds taken out to buy dss a good heavy gold chain. Hoping it's something they can wear all the time and remember it was from me So that just leaves clothes and furniture.

So do I need a will ?

YES! Everyone needs a will. It prevents a lot of problems. Please talk to a lawyer about a will and also ask her/him about a trust for your children. This is important!

Yes. I am a lawyer, do not practice trust and estate law but I have assisted a pro bono client with obtaining some small items left by his mother who did not have a will. The time and hassle for him to obtain the few hundred dollars in her checking account was way too high. He didn't pay anything as I took his case through the pro bono program at my law firm at the time. The cost would have been more than the money he was going to receive if he had to pay an attorney.
