Dear BC sisters, I have seen several threads about mastectomy and minimum stays, what insurance will cover, etc.  I became curious and went the the State of Texas site and found the statute for Texas patients.  It works hand in hand with the federal law.

Perhaps if you check with your state's insurance statutes, you might find similar information regarding your medical rights.

FYI: Texas already has a two day minimum for mastectomy and one day for lymph node removal rule.  If recovery goes smoothly, the minimum may be over-ridden by both the health provider AND the patient.  From what I read, it looks like BOTH must agree to the earlier discharge.  I wish I had read this before my diagnosis because this information is helpful.

The link to the statute is  http://tlo2.tlc.state.tx.us/cgi-bin/cqcgi

In case I mistyped the address, go to the State of Texas legislative website and Click on statutes, click on search tab and type in 1357.004
