    Allegedly.

    Interesting complaint - so far, kind of weak, but interesting, nonetheless.  Can't wait for the facts to come out at trial - I wonder if they'll self-publish the discovery documents, if they're not positive to the woman....

    Even according to her own action, the company was willing to pay her while she was under-going chemo and radiation.  She was a supervisior and no reasonable accommodation could replace her actually being there, supervising her personnel.  Even Steve Jobs took a leave when his medical treatments made it too difficult for him to perform adequately at his position.

    She alleges she was able to work, but needed a "week to recover from chemotherapy" to be well enough to have a conversation with the CEO?  Clmon...  

    This is a wonderful country.  We can sue for anything and everything under the sun.  It doesn't mean she either will or should win..

    Not sure if there's any merit to this lawsuit and of course no one should lose their job or be penalized for having cancer. Even if there is merit here, I don't believe it represents the tech industry. In my experience it can be a pressure-cooker during normal times but they recognize extraordinary circumstances and make accommodations (one friend continued to work during rads but worked from home and had a flexible schedule)

    I think knowledge of any type of cancer by your employer puts you at risk for finding yourself without a job. I worked for a company about 5 years ago that used their "downsizing" tactics to get rid of a few people who were known to have cancer. Men and women, some young, some older. FMLA is great when you are going through things, but no guaruntee something won't happen once you are off that protection.

    I work for myself now, so I am keeping my health issues private so as to not be discriminated against by my clients when it comes to work. It is one of the benefits of working for yourself, they don't need to be told. If you do, you are just giving them reasons to not use your services. I have to carefully manage my time with them, where I can work from, and whether I need to pass on something or opt out if it is going to be too much.

    Jazzygirl: That happened to my husband too.  I had first breast cancer in 2005.  His company started downsizing and the company started with highest salary(system anaylst for 32 years).  Two years later he was let go due to "downsizing" and was required to sign paperwork not to sue so he could get his pension.  He filed for his pension this Fall.  Needless to say, we were w/o income and lived in my mother's basement until a job came along 4 months later.  I worry about this happening again since I have a new breast cancer and the treatments that follow.  Really, really scarey now that he is in his 60's.  Life does go on and we just take it one day at a time now.
