When I was diagnosed in November  2008, we fell behind by a few months in our house payment. Contacted the bank immediately. Even had an outside counseling service helping us who quit after 6 months because all the got was the runaround from bank of america.  Well I continued on trying to  get a modification of our loan, all this while undergoing the double mastectomy and 6 months of chemo. Well modification went through in July 2009, we signed papers to pay 972 a month. A week later we got our first monthly bill and it was 1250. Now tell me this. Our original monthly payment before the modifcation (at 972 a month mind you) was 1049 a month. How in the heck did they expect me to afford 1250 if i could not do 1049.  How does that help me??? Contacted the bank,they said they made a mistake but too late to correct it, advised us to fall 4 months behind in order to qualify for a new modification which we did (fall behind) and in the last 10 months (thats how far behind we are now) we have been denied 2 times, sent in paperwork 4 times, and litterally just got ran around and around.  Friday they asked me to send in all financial docs again, which were ready to go today, until I received the letter that the ony alternative I have now is short sale, deed in leui or forclosure. 

I'm just devasted. Hubby and I have been together 25 years, took us 20 of those years just to get our own home (and its a trailer lol) Fought to keep it all this time, even up to today and just to fund out they were running me around the whole time. And we still lose it.

 I found out that because we had a Countrywide loan to start with, that Bank of America gets $30,000.00 incentive for each home they foreclose on that was previously owned by countrywide.  They have a bigger incentive to foreclose than they do to try and help us keep our home.

 I am devastated.  What is wrong with our country that big business can do this. I just don't understand anymore.

    That's horrible.  Have you considered going to your congressional representative or Senator.  I'd be making a very loud stink with their staffers to put some heat on BOA.

    The next few days will reveal what is "really" wrong with our country and the entire world will know it!

    I agree with Chickadee that you should contact your Senator and do it by email AND telephone.  People like you and millions of other Americans are getting the shaft while the Dems and Repugs play games with our country trying to make the other look bad.  The Repugs are so determined to get Obama out of office that they will risk , imo, destroying our economy and country to do it.  The Dems are so hungry to make the Repugs look bad that they will do the same thing not caring that the average American like yourself is suffering so badly and has no one to turn to.   Your treatment is abominable and what is so sad is that your suffering is probably being repeated by many, many others who don't have a place to voice it.  I do hope you will get your letters off to any one in Washington you think will listen.  When I have a gripe, I write to Obama, The Speaker, my Senator, and any one I know who is running for President in next election.  You may not be their constiuent but they WILL want your vote if they are running for an elective office!  Best of luck to you!

    I'm very sorry this is happening to you.

    It is commonly known though, that you should not fall behind on your payments and anybody advising you to do so is scamming you.  It's been in the papers.  I'm sorry that bad advice got to you and I hope you find a way out.

    And, Medigal, your comments are out of line.

    So so sorry to read this.  What a tragedy for you and your family.  I pray things work out for you...somehow....someway.....asking God for a miracle for you.

    I'm so sorry this is happening to you.  Along with the other suggestions you've gotten, I'm wondering if there's an investigative reporter at a local or nearby TV station who would pick up and report on your story.  Perhaps someone in B of A's PR department would feel compelled to make it right, or maybe someone in government or just a benevolent, compassionate individual would offer to help with a new loan or other assistance.  What's happening to you is just plain wrong, and getting your story out might be helpful.  Otherwise, you might be better off doing a deed in lieu and trying to move beyond such a negative situation.  (((Hugs)))  Deanna

    Hate that this is happening to you - email your congressman/woman first thing tomorrow - then phone them - they will have a local office (look in blue pages of your phone book) they also have caseworkers that your taxes pay for they can be most helpful - I also agree that contacting the local media is a good idea - they usually have their email address at the bottom of their articles - I have had great good luck getting them to answer me in both Canada and the U.S.   With a little research you should be able to find out who the chair of the banking committee in congress is and that's another contact you should make - again email but I'd also follow up with a letter - just write what you posted here - it's plain enough and gives them the story - you can add details later if need be.  Good luck and know that everyone here is pulling for you - you are not alone in this so many Americans have been scammed by the banks and mortgage companies - I still want to know - WHY ISN'T ANYONE IN JAIL???????!

    That is horrible.  Is there a pro-bono or local free law clinic or law school that could take your case?  I moved out of my home once I realized I couldn't afford it and rented it out, then I rented a tiny apt.  Not the best solution, but a solution.  Is there a church you belong to that could help? Can your local Cancer Society help?

    I feel for you.  It is so unfair and stressful.

    I am so very sorry you are going through this - what a horrible time to have this happen.  I agree with Sherri, if you do want to contact your Congressman, a visit to the local office gets better results.

    Call the local news station; they'd love to play up this angle and put pressure on the bank to do what's right. I'd contact the local newspaper, too. Publicity is your best friend now.

    Contact Chris Coumo at ABC news.... he's got unbelievable resources and may even take this on as a 'project', as he loves to go after this type of scam/situation with the banks.

    Coolbreeze:  Just because you don't keep up with the news doesn't mean what I post is "out of line".Why don't you pay more attention to what is going on in Washington before you criticize what I post?  If they would quit playing "gotcha" with each other maybe our almost homeless poster would not be in the position she is in and they could really help her.  Does "August 2nd" mean anything to you?  Sorry.....maybe you will be busy posting how "out of line" I am and won't notice what "may" happen.  Have a nice day!

    I have to be with Medigal on this one.  Not out of line, but very much illustrative of the problem.  Our bickering politicians and the fatcats that they kowtow to.

    TSmith .. I'm so sorry you are going through this.  The Making Home Affordable program through BofA is a huge mess.  I applied for it as well, even though I hadn't missed a mortgage payment.  But my debt ratio was so high that I qualified for a reorganization of my mortgage payments.  The MHA program wasn't designed to make our total mortgage loan smaller, just reorganize it so the payments would be less each month. 

    My primary mortgage was also through Countrywide.  It took 13 months before I heard back from them.  I was constantly getting requests for more information from various different places.  It was impossible to track them down and get current information. My local BofA was of no help to me.  They didn't have a clue how the program was administered .. or even who to contact with questions.

    What is so appalling is that the funds are there for this program, but it has been grossly mismanaged.  I have read so many horror stories on the news of people who did what they were told (let their mortgage payments go for three months) and they would be helped.  That's what they recommended I do and it scared me to pieces.  So many people followed their advice and have lost their homes.

    This program really is a travesty and there should be some sort of govt oversight into what has happened, especially with BofA.  A friend of mine used the program through Chase Bank and was able to lower her monthly payments about over $800. 

    My heart goes out to you and I hope you are able to keep your home.

    It's obvious that BOA maintains a dysfunctional workforce.  While I am not in your situation, we did use BOA to purchase our current home 4 years ago.  It was a nightmare from beginning to end and the employees have really crappy attitudes about their own mistakes.  I think they just have gotten to the "I don't give a rat's ass" mental place about their daily work.  If this Making Homes Affordable program is being administered out of Jacksonville, Fla. where the mortgage people are, you have my utmost sympathy.  Horrible customer service.

    Local congressional office, the sooner the better.

    How about contacting your local news?  I would hope that public outcry might get BofA to reconsider?? Just a thought......

    I am so very sorry you are facing this awful situation.  Especially facing BC at the same time.  I agree with your local news station.  Big corporations hate that stuff.  All the best to you.  Keep fighting them!

    Have you tried calling your nearest Fair Housing office?

    Here is info on BofA's own "National Homeownership Retention Program for Countrywide Customers".  Sick to say, but, maybe you can find info that their own employees can't.
