getting records

I was just told by the chemo place I have to pay to get my records per page. 25 dollars for 2 pages and it goes up from there. They will fax them to the new place, but will not give them to me. Has anyone else had this happen?

Nope. I would call the American Cancer Society. They can help you with these kinds of issues. I have never heard of charging let alone $25 for 2 pages! I took films and disks from the mammogram place and brought them to my doctor… no charge. My former gyno sent me 2 copies of my records, no charge.

Never heard of such a ridiculous charging for your own records...I've never had to pay a penny for records, film or cds with my info on them.....Is this a reputable center??..What a way to sock it to someone who has been through enough!!!..Shame on them....

    "Medical Records Copying Charges

This web page lists the various state statutes that control the amount of money doctors, hospitals, and other health care providers can charge a patient for copies of their medical records, as well as records provided to the patient's attorney or law firm for use in personal injury cases. Note that under the Health Insurance Portability and Accountability Act (HIPAA) a covered entity can only charge "reasonable" cost-based fees for providing the medical records to patients. See 45 CFR 164.524(c). Arguably, fees that are not cost-based, even if permitted by a state statute, may be contrary to the HIPAA regulation and therefore preempted by this federal regulation."

    Further down the page:

    Florida
    Florida Statutes 395.3025

    Regarding records from hospitals:

    * Exclusive charge for copies may include sales tax and actual postage
    * Non-paper records not to exceed $2.00 per page
    * Paper records not to exceed $1.00 per page
    * An additional $1.00 may be charged for each year of records requested

Florida Statutes 395.301, Itemized Patient Bill

    * The facility may not charge the patient for making such verification records available; however, the facility may charge its usual fee for providing copies of records as specified in s. 395.3025.

    Rule 64B8-10.003, Florida Administrative Code

    Regarding records from physicians:

    * No more than $1.00 per page for the first 25 pages of written material
    * $.25 for each additional page
    * Actual cost of reproducing nonwritten records such as x-rays
    * "Recognizing that patient access to medical records is important and necessary to assure continuity of patient care, the Board of Medicine urges physicians to provide their patients a copy of their medical records, upon request, without cost, especially when the patient is economically disadvantaged."

lago, Thanks for the info. This place seems to be mainly about money. They said they would fax all records to the new Onc. without charge, but will not give me records wtihout charging me. I will have to print out the page you gave me, and see where it goes from here.

somanywomen, I agree ever where else has been great, it's this place.

lago, good idea, I will call them in the morning.

This is the same place that started the chemo to soon that has caused all my problems. I'm still trying to get the breast to heal from the radiation/chemo burns. It's been 8 weeks sinse that 1 chemo treatment, and it's still not resolved.
